TRADITIONS OF RUSSIAN LEGAL EDUCATION AND SCIENCE IN LEGAL AND SOURCE STUDY DISCOURSE: SOME ASPECTS

Resume: 

The need for a thorough source study of the history of legal education and science in Russia is considered as a research problem. Its understanding and promotion is seen as one of the areas of legal and historical-legal source studies, which is still under development in domestic jurisprudence. In connection with the development of linguistic, literary, museum, and other source studies, source-based co-creation is said to be promising.

The author analyses the surveys on the history of domestic legal education and science undertaken in post-Soviet Russia, and concludes that there are no clear and sustainable strategies for the source description and analysis. Attention is drawn to the evolution of the category «source» and the signs of historical and legal sources. The author shows why it is logical that normative legal acts and their projects, as well as scientific works of jurists are dominating carriers of information about the history of the analyzed branches of education and science. In connection with the quantitative growth, diversity, complication of sources, as well as the inevitable expansion of access to them in modern society, it is necessary to refer to other carriers of historical, legal, historical-legal and other information in studying domestic traditions of training professional legal personnel and the development of scientific jurisprudence.

The author proves the need to refer to museum source studies. Based on the experience in the museum of the history of the law university, a conclusion is drawn about the significant informative potential of museum items and collections as sources of studying traditions of domestic legal education and science, as well as local law and university history. The author thoroughly describes clerical documents as a type of written sources and a source array, and shows its significance for legal, educational and jurisprudential problems in their historical projection. The need to develop some other plots of source studies of the history of legal education and science in Russia is emphasized; the conclusion is drawn on the need to consolidate the efforts of many researchers in the development of legal and source study discourse.
